How to Report Defamation and Other Rights Infringement
Report: fill in the form faithfully, attach all required documents, and submit. If the form is incomplete, for example due to missing documents, the report may not be accepted. Reports may be filed only by the party (an individual or the representative of an organization) who is directly or indirectly mentioned in the post and is suffering harm, or by an agent authorized by that party. Processing a report takes up to 5 business days (excluding weekends and public holidays).
Required Attachments
1. Rights holder's identification or agent's supporting documents (required)
Please submit the rights holder's own identification (the last 6 digits of the resident registration number, address, and date of issue must be masked), or a copy of the agent's identification together with a power of attorney. If the attached identification falls under any of the following, the report may be rejected.
- The identification is not of a verifiable type (a certificate issued by a public institution, such as a resident registration card, driver's license, or passport)
- All four corners of the identification are not visible
- The identification is blurry or the information cannot be accurately confirmed due to light reflection
- The identification is damaged or invalid
2. Other related supporting documents (optional)
If you have any related supporting documents that can prove the defamation, please submit them as well.
Notes on Reporting Defamation and Other Rights Infringement
Once a report is processed, the reported post is forcibly unpublished for 30 days and cannot be arbitrarily reinstated before that period has elapsed. When action is taken, the publisher of a post that may constitute defamation or insult will be notified of ① the reporter's name (business name) ② the request to suspend reproduction and transmission or the reason for the report that you wrote. If a request to suspend the reproduction and transmission of a post is made without legitimate authority, the requester must compensate for all damages arising therefrom. Submission of a rights infringement report is deemed consent to the above obligation to compensate.
If the reporter makes no further request, once the temporary measure period (30 days) has elapsed, the publisher of the post may republish the post that was unpublished by the temporary measure. However, if the post was published under the publisher's legitimate rights and does not infringe the rights of others, the publisher may request resumption of the reproduction and transmission of the post even within the temporary measure period (30 days). The reporter may not repeatedly request action against a post restored through a request to lift the temporary measure or a post republished after the temporary measure period has ended. All procedures after the end of the temporary measure period follow an agreement between the parties or the lawful requests for cooperation, recommendations, and rulings of the relevant investigative, arbitration, or judicial authorities. If a reporter claiming rights infringement applies for deliberation and mediation with a relevant authority such as the Korea Communications Standards Commission or a court regarding a post under a temporary measure and proves that the post infringes their rights, the post may be permanently deleted.
Postype is obligated under Article 44 of the Act on Promotion of Information and Communications Network Utilization and Information Protection to immediately suspend the reproduction and transmission of posts that may infringe the rights of others and to notify the rights claimant and the person reproducing and transmitting them. To fulfill this responsibility as an online service provider, we receive and process reports of posts that may infringe rights. However, because Postype is a platform operator that brokers content transactions, we are unable to make legal determinations as to whether a post actually infringed a user's rights, whether it is unlawful, or whether grounds for justification exist. Therefore, you must obtain a determination on whether rights have been infringed and a decision on the measures to be taken through a duly qualified relevant authority. The Rights Infringement Report Center is operated to prevent further rights infringement until a relevant authority renders a final determination, and is merely a temporary means of protecting all users until the dispute between the parties is reasonably resolved. For an ultimate resolution, please proceed through legal consultation and remedy procedures via the relevant authorities.
